Our Female Lawyer is Equipped to Handle Your Upcoming Divorce Case

New York State recognizes no-fault divorce in addition to the traditional grounds for divorce. Even if you have been informally separated for a long time, you can now get divorced under this no-fault law. Our divorce attorney can be your guide, providing legal advice, and help you understand the guidelines for divorce, as well as the distribution of property, debt, and assets.

Equitable Distribution guidelines govern the distribution of assets and debts, ensuring all fiscal matters are accounted for. Ms. McCready can guide you through the intricacies of the financial issues that must be considered in these situations. Determining custody and access to the children of a marriage requires knowledge not only of the law and the workings of the court, but also an understanding of human relationships and psychology. As a child custody lawyer, Maureen McCready has extensive experience and success in both crafting agreeable settlements and trying custody cases to judicial determinations and appeals of these judicial decisions.

What to Expect During Your Divorce Proceedings

After years of practice, Maureen A. McCready is prepared to guide you through each phase of the divorce process. Explore the typical divorce process below:

  • File a Petition Even if both spouses agree to a divorce, it’s imperative that one of them files a petition with the court. This document is used to formally ask for a divorce and state the grounds for the divorce.
  • Temporary Orders Oftentimes, one spouse depends on the other for financial support. Whether or not children are involved in the relationship, one spouse may need to ask the court for temporary orders for support. For example, a stay-at-home mom will most likely require financial support from her husband in order to pay bills and support their children.
  • Service of Process The party who files for divorce must also file proof of service of process. This document is used to show that a copy of the divorce petition was actually presented to the other party.
  • Response The individual who receives service of process will ultimately be required to file a response to the petition. If the divorce was sought on faulty grounds and the responding party wants to dispute these grounds, they will need to address these matters in their response.
  • Negotiation Most times, both parties don't agree on all issues. In these instances, the couple must negotiate their differences. If required, the court may order settlement conferences designed to urge the parties toward a resolution of their issues.
  • Trial If a couple is unable to resolve their issues, matters must be decided at court. In most cases, going to trial will prolong the divorce process, cost quite a bit of money, and end in unpredictable results. Keeping this in mind, it’s best to avoid going to trial if at all possible.
  • Order of Dissolution This document officially ends the marriage and outlines how all property and debts are to be divided. Orders of dissolution also describe custody and support rulings. If a couple negotiates their own resolution, they may draft the order of dissolution and submit it to the court.
